    Hi,

    I am currently on H1 B with an academic institution (non science). My visa expires June 2013 though my job ends this June.

    I have received a new academic job offer with a start up date of August, 2012. Since there is a more than a month's gap between the two jobs, the H1 B cant be transferred. Even the new institution does not want to move the start up date to make the transfer possible.

    In that case, I am going to go to India in June. My new employer is going to process a new H1 B for me and give it to me before I leave for India, So that I can take the I797 to consular office for visa stamping.

    Do you think this one month break between the two jobs create problem in getting me visa?

    I will really appreciate your suggestion

      No issues as long as you leave U.S immediately after your current job ends and return back on a valid H1B visa and the newly approved petition after that petition becomes active.

        Thank You very much.

        I plan to leave for India 15 days earlier (as it is summer time, so no teaching) and plans to come to US just a week before my new job begins. I hope it should not create a problem
