  • H1B Stamping.

    Hello everyone...I have few questions regarding my H1B visa stamping. (@New Delhi Consulate)

    1) When I book my visa appointment date, I have entered my I-797 end date incorrect. Like..
    If my begin date 01/10/2010 entered same.
    If my end date 09/01/2013 , I entered 01/10/2014 ( this date was in my I-129 petition, Whenever my petition approved, my employer told me book the date according to I-129.)

    2) My employer is saying that it's a minor mistake, if they approve visa they will issue according to I-797.

    3) I can reschedule it, but I don't have that date...And also I made my plans. Is it going to effect a lot?

    4) One more question...I have received my employee-employer relationship RFE , my employer answered for it and it is approved. If VO asks about anything , Can I say about my RFE ?

    Please answer my questions...Thanks a lot.

    >>> The employer could have requested an extenion for 3 years and USCIS might have granted it only for 1 year. How can you go by I-129 in that case? While booing the visa interview you need to go by your approval notice.

    >>> It is not advisable to take that risk. See if yo can get ot corrected by talking to VFS helpdesk.

    3) I can reschedule it, but I don't have that date...And also I made my plans. Is it going to effect a lot?
    >>> Talk to VFS helpdesk to see if they can help you fix it.

    4) One more question...I have received my employee-employer relationship RFE , my employer answered for it and it is approved. If VO asks about anything , Can I say about my RFE ?
    >>> VO will not care about the RFE. You may have to prove that employer=empl9oyee relationship really exist by producing enough documents. Get the same set of documents what was give to USCIS to resolve the RFE and that will help. During visa interview, rather than documents, what really matters is how to respond to questions related to employer-employee relationship. So be prepared to answer then correctly.

      I talked with VFS..fortunately they modified the date...they were so patient...Thanks for your suggestion.

      i got 7 pages RFE regarding employee-employer relationship....I hope I will explain well to VO.
