Hi,
I am currently on H1 B with an academic institution (non science). My visa expires June 2013 though my job ends this June 30, 2012.
I have received a new academic job offer with a start up date of August, 2012. Since there is a more than a month's gap between the two jobs, the H1 B cant be transferred. Even the new institution does not want to move the start up date to make the transfer possible.
In that case, I am going to go to India in June. My new employer is going to process a new H1 B for me and give it to me before I leave for India, So that I can take the I797 to consular office for visa stamping.
Will it create a problem if I take a visa appointment in the first week /second week of June (by that time I am still an employee of institution 1 and my job ends only at end of June)?
