  • H1B 7th Year Extension - When can be applied

    Hi All,

    I am in my 6th year now, which is ending in August, 2012. My employer has filed my PERM in July, 2011, which got into general audit and now in pending status. Not sure when the result will come for that.

    When I can apply for 7th year of H1B extension on based upon 365 days rule? Should 365 days have been passed before I could apply or I can apply within the last 180 days of my H1B expiration date, as I am eligible under 365 days rule? I don't want to be in a situation where my current PERM gets denied and I will have to leave the country. If I get 1 more year of extension well before, I still stand a chance of applying another PERM.

    Please advice...

    It can be filed 180 days prior to the current I-94 expiry date.

      How about the validity,

      Thanks a lot for your response, really glad to know this . Have one more question, will the extension approval have any "From Valid" date having same date as 365 days are over? I think approval is just an approval, it'll have new expiration date as August, 2012 + 1 year.

      Please advice...

        Please, anyone can advice on the validity date of proposed H1B extension? Will be highly appreciated...

          The I-94 attached to the approval will have a 'valid from' and 'valid to' date. Take your old approval notice / I-94 (that is received due to an extension / transfer) and check that.
