    Hi,

    I am currently on OPT till Dec 2012. I graduated in December 2011 with my MBA (management concentration). I work for Bank of America but my position does not qualify for the company to file for me for H1B. I could probably get the needed position or even find another job in a different company that could apply for me. But my friend invites me to do business with him. He is a disabled veteran. He started a roofing company in November 2011. As for now he is the only employee. He registered a sole proprietorship which we could change to LLC or Inc. if needed. Now he asks me to join him as a 50% shareholder. We would have subcontractors working with us. We may have several employees, like a secretary, etc.
    The questions are:
    1) How high is the risk of being rejected H1B in this case as the company is recently started and is a small company?
    2) If H1B is denied can I find another company and have them file H1B for me for the same period for which it was denied Oct 2012-2013? So, can the application be filed for me for H1B second time if the first time it was denied?
    3) If H1B is denied, then would I be able to continue my OPT?
    4) Is there a difference for being approved H1B if sole proprietorship vs LLC or Inc files for me?
    5) May I still continue to work for BAC while a different company filing for me for H1B?

    Please suggest the best way for me to get my H1B. Thank you very much for your help!!!

            I'm new to the discussion, but from what I understand, the risk of H1B rejection may be higher with a recently established small company. Consulting an immigration attorney for personalized guidance is advisable. H1B Get more guide and assistance stripes roofing.....
