    Hi,

    I am going to apply for H1 in April 2012 (Expedite Process). I am on OPT now.
    1. Can I apply for my wife's H4 right after my H1 get approved ? even before my H1b visa start date october 1,2012. ? wht documents do I need, cause I am not able to provide my H-1Paystubs.

    any other suggestions.

    >>> I guess yo mean H4 visa at the U.S consulate. Yes, but she cannot travel to U.S before Oct 1st.

      What do you suggest, Expedite process or normal process for H1B ?
      If I apply for expedite process then at least I can apply for my wife's visa in May / June, eventhough she will not travel until Oct 1.

      Please let me know ur suggestions.

        Either one is fine. Premium will take an additional $1250. Even if you file in premium, you cannot start working in H1B status until Oct 1st. Your wife cannot travel until to U.S before Oct 1st. So think if it is really worth spending an additional $1250 just so that she can attend the visa interview earlier.

        But then the advantage of attending the visa interview earlier is, if she receives a 221g for additional documents during her H4 visa interview, then you will have enough time to prepare the documents and send it back to her. 221g can take about 2-3 months or sometimes more to get resolved. From that point of view, going for the visa interview earlier is good.

        You need to decide which is better for you.
