  • H1 Interview for Husband

    Hi

    I am on H1B, and My Fiance is in India. He is working over there. We are getting merried on 14th Arpil this year. Will there be any issues for his H4 ? I do understand that the H4 visa holder shouldn't be working and shouldn't show the intrest of working. However, Can we mentioned that my Husbund is planning to study for 2 years as, My H1b is also valid for 2.5 years, so we wil be back after that ? wil there be any issue if we show the intrest of study on H4 ? also, in case interviewr ask who will be paying for fees, Can he answer that I (wife) will be paying his school fees?

    I will appreciate your help.

    Let him appear with all required docs as mentioned in


    He will be granted H4 provided he has no intent to work or study.
    Should not show intent for studies as there is different Visa F1 for the same.
    Just like how he should not work on H4 also he should not study on H4.

      H4 status holders are allowed to study in U.S. However, unless asked, you can mention that the primary intent to apply for H4 is to accompany you as a dependent.

        This information is incorrect. H4 holders are allowed to study. However there is no need to mention this during the visa interview as the officer might ask to apply for F1. Mention the primary reason for applying H4 is to accompany the H1B holder as a dependent and later when you are in U.S, yu can find a university that accepts H4 holders and you can enroll in courses. The only disadvantage of studying in H4 is you cannot get OPT/CPT like F1 holders.

          Where do you get these things? There is no such requirement for H4 Visa. He can very well be intending to work or study or be currently working. He is not allowed to work while in the US in H4 status. His current work status does not matter at all. Intent of immigration is also allowed for H4 Visa. Be truthful in all your answers, there is no reason to hide anything.

            So, Is it ok to mention about study or not ? and if Yes, its ok, then what would be the answer for WHO will Pay for the school fees ?

            Isn't it quite tough to convention interviewer that his will stay at home on H4 and wont work?

                The interview will focus more on how you two met, how you got married and your job, employer etc. Stick to the truth and convincing will happen itself. The only requirement for H4 Visa is that you should have a legitimate marriage and you should be maintaining H1 status by having a legitimate job.
