Expired Date

I had the H1-b visa which was issued in jan 2008 and it was expired on 9 september 2011 can i use it or what i have to do?

Your employer can file a cap exempt petition for you, using the cap from the previous petition. By that, you do not need to wait until Oct to travel to US.

Are you outside U.S now? You cannot use an expired visa to travel to U.S. Any U.S employer can use the CAP from the previous H1B petition to file a new petition under the same CAP and request an immediate start date, provided you haven't spend all 6 years in thats CAP (H1B + L1 combined). Once the petition gets approved, get the H1B visa stamped and travel to U.S to work for the employer.
