221(g) for H4 Visa

I applied my H1B last year in Kenya and got it stamped in March'11 but as market was not good so i could not go to USA. This year my employer asked me to be ready to come to US in mid of March.I then applied for H4 in Feb 16 but VO firts asked why did you not go to USA till date and after answering his queries he gave me yellow slip and asked me to bring new employment letter and also contract letter for the company for whom i will be deployed in USA.
My company again delayed providing me those letters and got the same on 2nd April. They also asked me to join project by 20th of April.

Now i have no time and want to apply H4 from India as i am running out of time and next appointment is also available after 20th April in Nairobi.

My question is lets say if i go to USA and then can my family apply visa from India?
Do i need to fill in DS-160 and deposit fees again?

Need advise if i do as mentioned above will not cause any problem getting H4 Visa.

>>> Yes. The previous pending H4 application (if it was not rejected until now) should be withdrawn before you can apply again. The withdrawal need to be mentioned as visa rejection in all the future visa applications.

Do i need to fill in DS-160 and deposit fees again?
