Never stamped approved h1b can be transfered from india?
Hi,
My H1b Petition Validity Date is Oct 1,2008 through Aug 31, 2011 (i.e. expired). I never stamped this h1b. This petition was thorugh ABC INC.
I was working on L1b thorugh XYZ LLC and I came back to india Apr 2008 and joined to XYZ INDIA branch. left that job from XYZ INDIA in Sep 2008.
currently working inthe PQR company from OCT 2008 till date.
My question is:
H1b petition, which I have is expired and never stamped. This was my first h1b.
Can I transfer this h1b to new employer? or I will have to file for NEW h1b cap?
