I was working for CompanyA earlier and joined CompanyB...CompanyB filed my H1B transfer petition and there has been a RFE raised recently against that petition. Now CompanyB Attorney is telling that we cant address the RFE directly and we need to go thorugh Consular processing instead. He said he will give me a approved petition and I have to go either CANADA or INDIA [home country] and get my stamping done thorugh the US consulate. My questions are...
1. How likely it is that my application will be approved this way ?
2. What are my options if theapplication gets rejected by the consulate ?
3. Is there a difference between US consulates in Canada and India in terms of the chances of the application getting approved ?....I am asking this question because I am confused which consulate to visit !!
Plz advice.
