I got 221g green at chennai consulate.

I went for h1 visa interview on 3rd may 2012. Visa officer asked about my company, client, education, experience, Past US work experience(Since I already travelled and worked their on another type visa). after that he given me 221g green saying that my salary is an entry level salary. And told me that no need to come again for the interview but your company has to submit the new LCA with revised salary.

So my question is
1.) what will be the next step.
2.) whether i have to submit the passport with 221g green form and LCA? (not mentioned any thing on the 221g form abt the submission of passport)
3.) what is the process to get new LCA?
4.) how critical is my case ?

Till now my case is also pending from my employer...... No clue yet when it will resolve or what is the complexity of this 221g.......Please let me know if you got to know something...

I dont think thats legal ,,,asking for another lca due to salary,only uscis can refute that

Bro .. get a strategy in place with your employer and get on it right away. wasting days will not resolve your issue. you need to get up and kick some employer butt and work with them to get the process moving.

remember the more you delay the harder it will get.

In my case company is saying that Salary mentioned on LCA is correct. All got approval on same LCA except me. Dont know what to do ?

Is their any technical problem to get a new LCA for same location with next wage level for the same candidate ?

I am not getting any help from any where on my matter. Looks like a unique problem or they changed their policy recently and we are the victim.

here is what you should be doing per me ... [ remember i am not a lawyer / attorney but advice is off my experiance with this system ]

you can ask your employer's attorney to update your LCA with a updated salary .. which would reflect on ur new LCA within as few as 15 days [ 2 weeks ].

Technically we can either get the LCA ammended or apply for a new LCA . Now the new LCA may require more wait time and also not to mention the extra cost .. therefore see if you can talk ur employer into applying for a new salary range ... that should be enough..


once they do the amends they can just shoot they updated LCA to you and u can keep the same h1b approval and submit those documents to the embasy . also .. this process is faiurly simple from the employer point of view if he has his ducks lined up in a row.

As i said that my case is unique, VO given the 221g by saying to submit the revise LCA but the issues are

1. How much should be salary in new LCA to approve H1( how to decide this)
2. If company will pay more to one specific person then the conflict will come(policy level etc.)

I am fully helpless and not looks positive hope for me

frankly the base salary for a H1b is between 50-55 K .. if you are makeing more than that you should have no issues.,, but compare ur salary here and see what zone u are in
