    Hello,

    I have received a mail from VFS.

    As per the US Embassy your case has been returned to the Kentucky Consular Center in the United States. You may contact the USCIS office for further information. Please consider this case closed at their office.

    Is this denial? What should I do now? Do I / Employer needs to take any action now?
    please give me some inputs...Thanks

    This is not the end of the road.It only means that there is no more 'processing' at the embassy any more.USCIS would take a final decision and send a notice to your employer/attorney for which they will have an option to appeal against the decision by providing additional documentation.USCIS will then review the case and may approve/reject.If they approve you can then again go to the consulate for the visa.At this point,there is nothing your employer can do unless he gets a notice from USCIS.But all this process may take couple of weeks/months.

      USCIS will review the petition and send your employer request for more information. If they are satisfied with it, they will re-affirm the petition. After that you will need to contact the Embassy/Consulate again and they will tell you the next steps to get the Visa. This will take about 2 to 3 months.
