  • post h1b approval

hi I am on l1b with employer A and I got h1b approved from employer B with 1st oct(approval email states eff date as 1st oct 2012 and new i 94 number) as effective date. now what all documents new employer (B) should send to me before starting with employment with employer B? (like approval notice or new i 94)

Get the approval notice with the original I-94. The I-94 is yours and it should be stamped to your passport. Get a copy of the approved LCA. The employer should give you a copy of the approved LCA. Also, try and get a copy of form I-129. It will be useful in the future (during visa stamping etc). If you are inside U.S on Oct 1st, then you should be working for the H1B employer. Otherwise you will go out of status on H1B.

Thanks, I have also filled form for h4 for wife with h1b application. So as h1b is approved means h4 is also approved so employer should also give the new i94 for wife has well? (we are in us with L visa status now)

If the H4 petition is also approved, then the H4 approval notice would have come with a new I-94. get both the approval notice (I-797) and the I-94 from the employer.

New employer has forwarded the approval email received from uscis, also for documents like my i94 & petition, wife's i94 & petition will be shared with me after 1st oct 2012 when I join them.

Shuold I demand these documents before joining or its safe to get documents after joining new employer?

It doesn't really matter as long as you get it from the employer. The I-94 is yours. So try to get at least the I-94 and staple it to the passport.
