    I gave the interview for H1b in January at New Delhi embassy . I have a middle vendor between my client and my employer.
    The visa was refused because embassy felt that my employer does not have a direct control over me (which I think might have been because of some confusion.)
    But the petition was sent to USCIS for review, which we did not know about.

    My employer filed an ammendment to the petition for mentioning the middle vendor.
    I got client letters from middle as well as end client explicitly mentioning that they have no control over me and everything is assigned to me by my employer.
    I went for the interview with new petition and client letters in Feburary. The embassy kept my passport.

    In April, I got the reaffirmation for my first petition from USCIS and I was called for re-interview. I did not get any response from embassy since April.

    Later in May, I got a re-affirmation for the second petition. I went for the re-interview on 24th May and this time the VO gave me I221g green form and asked me to submit the following:
    1. End client letter
    2. emails with supervisor

    I had already submitted the end client letter (in all the four interviews). When I told VO that I have already submitted the end client letter (in fact I had just handed him my end client letter and it was in front of him), he told me to provide only the emails then. (This particular VO was taking my interview for the first time.)

    I submitted the documents yesterday.
    My queries are:
    1. Would the petition be sent to USCIS again for review ? The two petitions have already been reaffirmed by USCIS and I have not filed any other petition.
    2. What are the chances of getting a visa in this scenario ? I understand that reaffirmation of petitions does not gurantee a visa and is upto the VO to decide.

      Hi,

      I am having the same case as of you...It is only delhi Embassy that creates this type of problem.All other embassies doesn't create this type of problem.....and more importantly the VO doesn't give any valid reason for rejecting the visa.When petition has been approved by USCIS,it means that they have validated all information from employer that is why they have approved and re-affirmed the petition but these delhi people guys thay ask so much questions regarding the relationships between client,middle vendor and company and finally they get confused and doesn't issue a visa.


      This is really frustrating....

      It all depends upon your fate and upon the mood of VO taking interview....
