mutliple employers on H1B visa

If one is employed by a foreign company (e.g. a Chinese company) to do a work in the US; he enters the US on a tourist visa and then, in order to legitimately work in the USA, the employer (the Chinese company) opens a US company and hires him on an H1B visa.
Upon approval of the H1B visa, the employee is then hired and working for both companies: the Chinese and the US company (which is held by the Chinese company), although the H1B is only for the US company.
Is this situation is legitimate ? Can a person with an H1B visa work in the US for 2 companies at the same time, one American and one foreign ?

No. You can work only for the company who filed your H1B petition and got it approved. You cannot enter U.S in B1/B to work. It is against the B1/B2 regulation and it is simply illegal. A COS from B1/B2 to H1B is never advisable. There are plenty of posts that explains why it is a bad idea. Search and read them.

You cannot. You can only work for your H1B sponsor when you are in H1B status inside U.S.
