    Hi All.. Seniors/experts,,
    My case was sent to USCIS for reaffirmation after taking 5 months to complete the AAP. First kept under AAP, then sent back to USCIS along with the I129. I attended for the visa interview on Dec' 8th 2011. The VO collected all the original visa application package and gave me a 221(g) blue letter and included my case into AAP. Last week the US Consulate General Non-immigrant Visa Unit sent me a reply. They said my visa application was refused based on 221(g) of the INA and the rules there under and sent the case back to USCIS. They also mentioned they are waiting for the final judgement by the USCIS in my case. I don't understand what they mean this. Please all the seniors would you kindly clarify my doubts in this regard.

    My questions are....

    What should be the further process i have to carry on from my side ?
    How long its going to take for the final judgement to declare out in my case by the USCIS ?
    Can get back my all the Visa application package-originals collected by the VO at the time interview ?

    Please, please all the seniors help me out and advise me.

    >>> Just wait for USCIS to look into your case and respond. There are lot of similar cases sent back to USCIS which got reaffirmed later. In which case, the consulate will call you back for the interview or will request you to send your passport to issue the visa.

    How long its going to take for the final judgement to declare out in my case by the USCIS ?
    >>> That, no one can predict. It is case by case basis.

    Can get back my all the Visa application package-originals collected by the VO at the time interview ?
    >>> You can get the passport back. Other documents (I-797, LCA etc) would have been sent back to USCIS. You will get it only if the petition gets reaffirmed. Hope you have copies of all those documents.

      Confusion

      Thank you Shervin 143. I appreciate for your quick response. I was confused because the US Consulate, Hyderabad mentioned in the reply that they no longer going to deal with my case any more and asked me to contact USCIS for further information in my case. That's what worried me a lot and puzzled me.

      My doubts again are...

      Can my employer involve directly in this case to deal with the USCIS ? Or,
      What would be the role of my attorney in this case to deal with the USCIS as my representative ?
      Who has to take the initiation part to deal with USCIS in the reaffirmation case ? Is it my employer or the attorney ?

      It would be a great help if you make clear me these asap.

        You don't have to anything. Whether it be your employer or their attorney contacting USCIS is not going to be any help. USCIS will take a second look at the petition and if everything is good, they will reaffirm the petition and notify the employer/attorney. They will also notify the consulate and the consulate will call you again for the visa interview or will just ask you to submit the passport to stamping.
