  • Urgent - Changing Employer ( With H1 extension )

    My H1 expires in Sept 2012 and I got 3 year extension which expires in sept 2015.
    Can i change my employer, if yes, What will be validity of H1 from (new employer)- Is it valid until 2015 sept ?
    Please let me know. This is little urgent. I appreciate your response.

    Yes, you can transfer your H1B. The validity of the transferred H1B petition will depend on the work itinerary provided by your new employer to USCIS. If they can show work only for 1 year, then that is what you will get as the extension on your transferred petition.

        Changed employer last year

        Hi
        Petition to my H1B was approved with Employer A back in 2009 with H1B expiration date of September 21, 2012. Last year (2011) October, I changed my employer, and Employer B submitted another petition for change of employer with new 3-year from October 2011.

        I still have not received response from immigration regarding this change of employer.

        My question is because my original H1B is expiring on 9/21/2012, does my new employer B have to file an extension or last year's change of employer petition will automatically extend my H1B until October 2014 if the change of employer is approved?

        Your help will be greatly appreciated.

          You cannot be working for more than 240 days on a pending H1b approval notice. Time to upgrade to premium process or get your attorneys to do some work.
