How is the cap calculated?

My husband's H1B application was submitted today via courier. I have read that there is an estimated 6-8 week delay for receipt notices to be issued. As of today there are only 10 700 spots left in the cap.

What I would like to know is when they receive your application from the courier company is it immediately counted in the cap or only once a receipt is issued?

Only the generation of a receipt number confirms that you are counted in the CAP. If the employer has already send the H1B petition to USCIS, then you need not worry as there are enough CAP numbers.
