  • Withdrawing H1B Visa application

    Hi,
    After receving 221g Yellow my case is in Admin process. Due to this long delay I lost my project and now consulate send email to my employer and asked to provide details of project which I mentioned in DS -160 form.

    1 . If I will get new project , Can my employer replied to that email by providing new project details and mentioning that I lost my old project due to visa delay ?

    OR

    2. Can I withdraw my current visa application and once I will get new project Can I take new visa appointment with same petition and new project details ?

    3. Which option is better to get visa stamping ?

    4. Do petition needs to reaffirmed after getting new project ?


    Please let me know.....

    If the client has changed and the work location has changed, then a new LCA need to be filed and the H1B amendment need to be filed. The visa won't get approved without the amendment.

      So it means there is no need to withdraw the current visa application ?

      My employer only needs to do H1 ammendment with new LCA for new project.

      How much time it will take for ammendment ?

        10 days to get the LCA approved and 2-3 months to get the H1B amendment approved in normal process and 15 days by premium. Once you get them, send copies of these documents along with a new client letter in response to the 221g.
