H1b application with a pending temporary protected status
I'm currently on J1 (expiration Aug/11/2012) and have obtained a hardship waiver already. My prospective employer has applied for a cap subject H1b for me (cap subject: so for Oct/1/2012). My attorney hopes that I get my H1b approved with COS ( although I'll be out of status between Aug and Oct) because I have a pending temporary protected status application . Is that possible? If that happens will that mean I will not be out of status? Will that affect my abiliy in the future to adjust my status (i-485)?
