  • H1B with 2 employers...

    urgent help...!! I have just applied H1B with one employer, he says the attorney has already filed, this is small company and they are applying with internal project, I got an other oppurtunity with a good company and they want to apply my H1B, the second company has very big OIL client and it is direct client, they have PO,client letter etc.
    So my questions are
    1) Can 2 employers apply H1B for same person in the same CAP...?
    2) if No, then I want to stick with second company, will it be possible for the 1st company to revoke back the applied H1B....?
    3) will USCIS know that 2 employers applied for me and one of them revoked...?
    4) what is the best way to approach in this situation please advise...?

    Two employers can file H1B for you at the same time. No issues.If both the petitions get approved, you get to choose which employer to work for.

      As long as you reject the offer from the first company, you should be fine. The employer would probably cancel their petition.

        The CAP for 2013 has already reached. The new employer will not be able to file you a new H1B petition for you under a new CAP. If you reject the offer, you will mess up the opportunity to work in H1B for another 1 year.
