unused H1B duration

My H1B got expired in March-2011 and it was my first H1B, i have not fully utilised that H1B for 3 years, right now i am in India and can my employer apply with h1b ?

Yes, they can file a cap-exempt petition. You are entitled to a total of 6 years in the US in H1/L1 status.
