H1B Cap exempt eligibility

Hi, I had H1B valid till April 2012(utilized it for only one year) with my previous company (say X). I am in India now and joined in new company. If i want to apply for H1B through new company in this year,(as cap quota is reached for FY13) am i eligible to apply in Cap exempt category as i had H1B with my old company.

Please let me know if i am eligible or not.

Yes, you sure are cap exempt and can transfer the petition to a new company.
