Visa issue due to overstay

Hi

I went to US on a L1 B visa valid from 2008 to 17 Jun 2011. I applied for an extension in the month of May 2011 and got an RFE in the process and finally rejected in the month of December.

I left US on DEC 30. My I94 expired as of Visa date Jun 17.

I applied for an H1 B petition for 2013 and got it approved recently. Since ; I stayed in US after the I94 expiry date will that be considered as Over stay in US and how does it impact my H1 B Visa stamping.

Please Advise.

Yes, it is overstay and you can explain the reason with paperwork proof to the VO during the interview.
