I am on h1 since 4 yrs but i dont have my w2's for all the years except for 2004 that too less than the lca. I recently got married and my wife went for interview and got a querry on that pl. help and advice me of something i will really appreciate your help

HI,

I am assuming that your wife went to Chennai Consulate in India for H4 visa stamping. Please remember that you are not the first victim of this. So many people are having this type of issue.

All you have to show them is why is your income less than what they specified in your LCA.

Could you please also let us know what type of documents did consulate asked your wife.

They asked for the marriage photographs,marriage certificate and w2 thats all and i am wondering how you guessed that it was chennai consulate

Hi,

Most of the refusals/queries for H4 visa will only be from Chennai Consulate.
I guess you need to submit the marraige photos and Registration certificate while applying for H4 visa. Also all W2 forms. It's Mandatory. Please check the chennai consulate web site for H4 visa documentation.

Also please let me know what kind of reason you are providing for you W2 forms mismatch.

how long it will take

hi, my wife applied for h4 visa on jan 3 2006, but the officer put mandatory adminstration processing under section 221(g) INA and told her that they will call her after 21 days, but its almost more than 2 months no reply from them. when we call to embassy they says ur case is pending, so can u plz help me what can i do,( my status is H1b, waiting for ur reply)

Please share updatations regarding this case. Why W2 having less earning? I am also one of the victim. still i don't have clue how can i give explanation for the difference W2 wages with LCA. I got married, But i am unable to bring her here to USA..

Seems like Samsai is in a tight corner. Some hope is left if at least the W2 of 2005 has wages in accordance to the LCA. HAve you been with the same employer for all these years? I am sure you are aware that not being paid while on H1B will be construed as being out of status. If you have proceeded to change the employer, and if the present employer is paying according to the law, then you might want to make an attempt again. Otherwise, do not send your wife to the consulate again unless you get a good pay, or shift employers, and you choose to get your H1B transfer stamped for the new H1B visa.
