  • from L1b to H1

    I am working for X company and having i94 status valid upto december 2012
    Y company already applied for my H1 for October 2012
    Now my current X company want to apply for my extension
    So in that case i have following question

    1) As my current company does not aware about my H1 application, they will fill current status of i94 in my extension form so in that case if some inquiry will come from USCIS then in that case my company will come to know about my H1 application status?
    2) Though Y company applied for my H1 but say before october if my L1 will get approved then what will be the case of h1?
    3) Is there any conflict situation if both the applications are in USCIS?

    >>> No.

    2) Though Y company applied for my H1 but say before october if my L1 will get approved then what will be the case of h1?
    >>> Search and read about the last action rule. whichever petition becomes effective last will be your status.

    3) Is there any conflict situation if both the applications are in USCIS?
    >>> If L1 petition gets effective after Oct 1st (h1B effective date), then you will remain to be in l1 status and cannot work for H1B sponsor. If H1B petition becomes effective after the L1 extension, then you will be in H1B status and you should be working for the H1B sponsor.
