Can stay beyond I94 expiry if applied for visa extension?

Hi Team,

I have my H1 Visa valid till 30th September and my I-94 is also valid till 30th September 2012 only.

My company is filing for my extension. But it could be possible that I do not get my extension approval by 30th september.

So can I stay beyond 30th septmeber in US or I need to leave US by that time?

Sept 30th is still far away, why not file extension under premium and get response within 15 days of application? A stay beyond I-94 expiry would be considered valid only when the extension eventually gets approved. If for some reason your extension gets denied, any time spent in US after your I-94 expiry would be considered illegal. This is my opinion not legal advice.
