  • H1B Stamping

    Hi,

I am currently in US on L1B, my employer has filed H1B with COS and is currently with USCIS.

    Questions:

    1. What is the current success rate to get approval for the petition?

    2. If it is approved, do I need to get the Visa stamped ASAP or can I go after few months?

    3. If I go for stamping early next year, then what are the chances of rejection?

    1. What is the current success rate to get approval for the petition?
    >>> No one is keeping track of these metrics. If your case is genuine and if all the documents are in order, you will get it approved.

    2. If it is approved, do I need to get the Visa stamped ASAP or can I go after few months?
    >>> If the H1B approval comes with a new I-94, then you can start working in H1B status as of Oct 1st until the I-94 expiry date. You will need to get the H1B visa stamped only if you had to leave the country inbetween and want to return back in H1B status.

    3. If I go for stamping early next year, then what are the chances of rejection?
    >>> Hypothetical question cannot be answered. No ne can judge whether your visa will get approved or not. It depends on your merits and the documents that you submit for stamping.
