  • H-1B Transfer and Start Date with the new Company

    I am working on H-1B Visa with Company A and have applied for H-1B Transfer to Company B. I have an H-1B Transfer receipt of my H-1B Transfer filing with Company B. My start date with Company B is 13th August.

    I am looking to work with Company A till 7th August and then use rest of the days till 13th August to relocate to a new location for Company B.

    1. Is it an issue to have 6 days gap between the last day (7th August) at Company A and the start date (13th August) at Company B?

    2. If yes, how many days of gap is permissible between the last data at Company A and the start date at Company B?

    Every single day that you are on H1-B you must be employed and paid otherwise you are technically illegal and out of status for that period. When you go for future stampings you will have to declare that you were out of status and even though it is for only 6 days, you never know if the VO would cause issues. The best thing would be to coordinate such that you relocate over a weekend (weekends do not get counted) so that way you avoid even a single day of illegal stay and have a clean record

      Suppose my last day at Company A is 10th August (Friday) and the joining date at Company B is 13th August (Monday). There is a gap of two days on which I would not be on any company's payroll.

      Is there a chance that VO interpret it as being Out Of Status or would it be normal to see such gaps? Just want to sure rather than being sorry later on. I appreciate your response.

        Weekends and National holidays are exempt from this scrutiny. This is my opinion , not legal advice.
