H1B stamping + changing employers

  • H1B stamping + changing employers

    I've been with my current employer from 2009 on a H1B visa. My employer (a small startup) promised to apply for a Green card this january, but I just discovered they never followed-up on it. I have a good relationship with my employers and believe this was due to negligence and not planned, but in either case I'm shocked and I'm looking for other opportunities. The catch is I need to go to India in December for ~3weeks for a personal issue, and need to get my visa stamped for the trip.

    1. Should I stick it out with my current company till after my trip in December and shift jobs after that, using my current companies documents to get through stamping.
    2. Change jobs ASAP (realistically in a month) and use the new companies documents for the stamping.

    Basically I'm looking for advice on is it risky to change companies so close to my stamping date. Thanks!

    Changing jobs close to stamping wont be an issue. As long as your new employer has all the docs in order you will be fine.
