    Hello.

    I am based out of Mumbai. My paperwork was filed with Company A in April 2011. I got my H1B Visa stamp in December 2011.

    I took up another offer with Company B (Bangalore) in August, 2012 and am waiting to be relieved by Company A.

    My original Company A wanted me to pay reimbursement for H1B visa. I contested it since the contract said 1 year has to be completed from date of petition being filed. Since that date was April, 2011, I had completed one year since then. I had heated discussions with the Finance and HR Head and eventually they agreed that I was not liable to pay them the money.

    Now they are delaying my relieving paper work and this is causing issues with my new Company B. One thing they mentioned is that as per BEP? (Business Enterprise Program?), I am supposed to get the Visa Cancelled on my passport before I can be given my relieving papers. I am not sure what BEP stands for or what it means. I cannot find anything online for the same either.

    What should I do? I do not want to give my original Company A my passport since I need to travel to Africa shortly for new Company B work.

    I need to resolve this issue ASAP and get my relieving papers!

    Any help and guidance is highly appreciated!

    Hello jaya.

    This is your right to hold the H1B un cancelled. BEP stands for Business Executive Program. Under which your company hold certain regulations and blanket visa approvals etc.
    You no need to get your visa cancelled if it is stamped with H1B or B1/B2.
    This happens only when you hold a L1B or L1 visa filed through your current employer.
    You can pay the H1B, if it legally holds true and based on your understandment with your employer.

      I do not want to pay the H1B fees since my new company does not require me to travel to the US. I just want my relieving documents. What should I do?

      If the answer is get it cancelled, then what is the procedure to get H1B cancelled? How much time does it take?
