  • H1B Change of Employer

    Hi,

My H1B petition just got approved last week with COS (I am currently on L1B), the H1B validity date is till March'15.

    Question:

Can I change my employer here?

Will it be a problem since I do not have H1B stamped?

    Thanks

Another employer can certainly file cap-exempt petition for you. You can start working for them after receipt or approval of their petition. Previous time spent in the US in L1 and H1 status will count towards 6 year limit.
This is my opinion and not legal advice.

But my Petition is already there, still the other employer needs to file a petition for me? Can they not transfer the petition?

Technically there is no such thing as transfer. Every petition is a new petition. What is commonly known as transfer only means that you are counted under annual cap and the employer does not have to wait until cap is open.
