  • H1 Transfer and Extension, Premium Processing

My original H1 petition is expiring September 30, 2012. I found a new employer who has filed for extension and transfer under Premium Processing. My attorney got the email receipt on September 1, 2012. They say that it takes 15 calendar days for adjudication. I want to know if anybody has undergone through same situation and have received the answer/ approval in 15 calendar days. Also I want to know after receiving the approval through email how long does it take to receive original I797 form.

    Thanks in advance.

Generally decision is made within 15 days from the receipt date. If an RFE is sent, the 15 days clock stops and it starts back after your employer responds. There is a higher chance of getting RFE if your current or new employer is a consultanting company.
Irrespective of that since petition is filed before your current I-94 expires, you can stay and work for the current or new employer until a decision is made. If you decide to join the new employer based only on the receipt, the risk is that if new petition is denied, you will go out of status.
It generally takes 1 week to receive the paper notice after the decision.
This is my opinion and not legal advice.
