Gurus, Here is my case:
- I am on L1 visa currently and work for Company A.
- Company A and B filed my H1 with Change of status with a start date of October 1st.
- I want to stay with Company A and not join B.
- The problem is that Company A's petition has received a RFE 2 days back and it will be well past Oct-1 before we get a decision on the response.
- No decision on B's h1b petition yet.
1. How can I avoid joining B?
2. In case I have to leap frog:
a) If my approval comes before Oct 1: I can do a round trip to India and get a new I-94 can continue my L1 status. Do I have to be in India for a atleast 15 days to get a new I-94 for my L1 at the POE?
b) In case my decision does not come till Oct -1st then , Can I leave US the day I receive the decision? Will the start day on the I-94 still be Oct-1st?
3. Does my family have to leap frog too?
