Hi,
I have an approved I-797 petition from 2006 cap.
This got transferred to the current employer in 2011 and also have a H1B visa stamped on the same.
However due to some misunderstandings between Management and myself, my employer has initiated for a cancellation without my notice.
May I seek your kind advice over the following questions?
1. What is the actual I-797 petition (approved) cancellation procedure and how long does it take?
2. Is there a cancellation fee involved?
3. If at all cancellation initiated but not cancelled yet by USCIS, can this cancellation be revoked?
4. Where can we see the actual status of I-797 petition (including cancellation status).
5. Once the I-797 petition (approved) is cancelled / revoked by employer A, can I transfer this to employer B at a later stage. Will I be exempted from quota / cap (considered as 2006 cap)?
Please respond to these question point wise, as this is directly related to my career direction.
Thanks in advance,
Regards,
Raj Modur
