NEW H1B while staying in U.S and have been outside of US for a year.

Hi,

I have valid H1B petition which expires in Nov 2012. However, i have been outside U.S since July 29, 2011. The option i have is that i can get a Visa stamped adding the un-used one year which will lead my new expiry to Nov 2013.

My question is can i file a new H1-B in April 2013 subjected to new cap while i am staying in US ?
