H1b visa unemployed

I am on h1b visa as a physical therapist and they petition me for eb2 visa as well but still pending and no updates yet. I have no work assignment yet for about two weeks now since i just came back from a 3 months maternity leave. My question is am I entitled to get compensation for the unproductive days? And if this will continue that they cannot find a job for me can i file a resignation? can they sue me for not completing my
remaining 8 months in the contract? If i resign from company can i look for another petitioner after or before i resign with them since i am still on h1b visa. Please help.
