I am a professional nurse from India. A Healthcare company in California filed an employment based visa petition on my behalf and I got a Green Card based on this. Early into the process, they verbally told me my salary would be 35 Dollars an hour, but did not send me any communication to that effect. However, they made me sign an Immigrant Visa agreement which states I should be employed with them for a minimum period of two years, and if I leave their employ before this two year period, I would have to compensate them for their expenses on a pro-rated basis depending on when I leave them. The only amount they have spent on my behalf is the immigrant visa fee and the NCLEX examination fee which amounts to approximately USD 500.00. This excludes the legal fees they may have paid the immigration law firm.
They sent me an offer which states I will be paid the exact air-fare and a month's accomodation. They made no mention of what I would be paid. However, just before I went for my interview at the US Consulate, they sent me copies of a letter showing I would be paid USD 18-20 an hour as salary. As my visa date was just three days away, I had no time to question them on this.
Even after coming to the United States, I am unable to work as they had not applied for my Board License in time and my name is on the wait list with the California Board of Nursing. While their letter clearly states that in the absence of a License, I could work as a Nurse's aide, while I wait for my License examination, they are now back tracking on this as well.
They are refusing to pay me for accomodation nor my airfare. They also informed me now that there are limits on both these payments and that I would not be paid at actuals, while their offer letter makes no mention of this. They maintain they will reimburse these expenses only after I commence employment and that too not at actuals. I have got my Green Card and Social Security Card.
Though this firm is a big one, I feel cheated as I think they have no work ethics.
What I would like to know is if I could take up a job in the same profession with another company after paying this company their so called expenses. Would this have any effect on my Permanent Resident status, and if so what? Is there any
minimum period for which I should work for this company?
