    Hi,

    I am on F1 right now in US. I am married and my husband( living in India) wants to come to US as a dependant on me. My husband is working in India.

    What are the possible questions and difficulties that may arise during VISA interview?

    Any particular documents or certificates VISA officers look at?

    What are the chances my husband will get a dependant visa?

    Also after he comes to US on F2, can he convert directly into H1 or does he have to convert to F1 first?

    Does he have to go back to India for changing his visa status?

    Please help!

    F2 Visa

    The below are some of the document required for F2. Some of the forms has been changed , please verify before preparing them.
    1) HDFC BANK RECEIPT
    2)DS 156,157,158 FORMS
    3)I-20 OF BOTH F1 AND F2(copy of F1 and original of F2)
    4)VISA APPOINTMENT LETTER
    5)SEVIS RECIPT OF F1(http://www.fmjfee.com)
    6)MARRIAGE CERTIFICATE
    7)MARRIAGE PHOTOS
    8)PASSPORT AND VISA COPY OF F1
    9)PHOTOS 50X50
    10)F1 EMPLOYMENT DETAILS (if working in usa on CPT or OPT)
    11)FI BANK ACCOUNT DETAILS (if statement is good with transactions)
    12)F2 BANK ACCOUNT STATEMENT(both current and saving account)
    13)IT RETURNS (if F2 is applying on his own company r shop)
    14)CA REPORT
    15)CE REPORT
    16)F1 PAYSLIPS(if F1 is working in usa on CPT or OPT)
    17)F2 PROPERTY COPIES.

    F2 do not need to go home country to change his status after coming here.

      Basically he will need the following.
      Documents related to your F1 status such as I-20, OPT EAD etc.
      Documents showing your relationship such as marriage certificate
      Documents showing proof of available funds such as bank statements etc. (better if entire amount as per I-20 is in your name or his, but don't make big transfers from somebody else to prove this, show that person as a sponsor instead)
      Documents showing his ties to home country such as property documents, job leave letter etc.

      More important than any documents are his answers. He should know everything about your exact status. He should be able to tell how you two met and got married. Most importantly he should know what his plan regarding returning to home country is. F2 applicants need to show that they will return to home country. Considering that he has a job in home country, he should have convincing and truthful answers about what he will do while in the US as he is not allowed to work or study in F2 status.

      If he does find a job he can change status to H1 directly while in the US. But, remember H1 annual cap for the next year only begins on OCt 1.
