  • H1B Visa from India

I am working in the Statistical Analysis (SAS) area for last four years in India. Currently, I am employed in India and never travelled to US. I am a certified SAS base programmer. I have done B.E. in Electronics and Telecom.

Recently a company in US is ready to file my H1B visa in the month of April 2006. My questions:

    1. Can a company in US file H1B Visa for a candidate in India?
    2. What are the documents I may need to get my Visa?
    3. How should I convince the consulate officer to get the Visa?

Your help is appreciated. Thank you…..

1.Yes , a company can file an H-1 for someone outside US.
2.After the petition filed by your company in US is approved,
you will get a noice of approval ,I-797. You will need this along
your bachelor's degree and other documents for the interview. Follow the H1 links on this forum's home page to know more.
    3. Unlike a visitor visa , you do not need to prove that you will return to India.(i.e. H-1b enjoys immigrant intent), so you do not need much
convincing if you have the approval notice and other documents.
But you must be able to explain to the consular the work you will be doing in US.Read more about H-1b interview guidelines in the very first thread
in the H,L visa forum.(visa tracker).
