USA reentry with less than 6 months on Indian Passport

Hi All,

I am currently working in USA on H1B Visa(I797 Valid through 09-2014) and my Indian Passport expires on 05-2014. I am planning to visit India for a month in November this year and during my stay there I will also get my H1b restamped(old stamp expired in 09-2011). I am planning to return back in Dec 2013.
Will I have any problems in reentering with my Indian passport having just under 6 months to expire? I am planning on getting it renewed once I back here.

The US will not give you problems with your passport expiring in fewer than 6 months.

Discussed it with my immigration attorney

Thanks for your response. I just discussed it with my immigration attorney. She says in this case they will just put my passports expiration date on my I94 which would leave me with very less time to get the next extension on H1.
I guess its best if I renew passport while I am in India. I will try the Tatkal option.
