  • How to wake up case I-797 that has been approved in 2009

    Hi,
    My sister received I-797 approval in 2009 but never send I-824 to USCIS for further action. Although, my priority date was 2001. How can I wake up this case again? I know I have to send I-824 form along with copies of I-130 and I-797 but, is there any other documents or letter to wake up the case which has been approved 5 years ago. Also, I don't see any expiry date on I-797, is it expired or what? Can I still file I-824 for further action? Is there any special steps for that type of case?

    The I-824 is only used when normal processing has not taken place. If this was a sibling petition, from a U.S. citizen, for UK processing, the waiting period for an eligible visa slot is about 12 years. When was the petition first submitted (Priority Date)?

      Sorry, but I just re-read your post and see that your Priority Date was 2001, 13 years ago. You need to contact the National Visa Center, phone: (603) 334-0700 (from U.S.) and ask for State Department case number. You will need the original receipt number received by your sister on the I-797 receipt or approval notice, names and birthdates of both petitioner and beneficiary. This is not the time to use an I-824, because you can more easily find if the approved case was submitted to the National Visa Center by telephone (or email), then proceed with normal processing or reopening if more than a year has passed since it became eligible for a visa slot.
