  • Extreme hardship waiver

    Hello,

I am a little confused... i am a US citizen and met my husband in the US but he had already had the order of removal in process... he left to Canada where he was granted refugee status, and I decided to come with him to live here in Canada. I have never been happy here, I am not used to the weather and have not been able to go to school first because I just got permanent resident status in 2011 (i couldnt study if I was not a PR) and that was when my first daughter was born here and 4 months after that I got pregnant again.. I dont have any family here or friends so we've been very lonely here. My daughters are now 2 and 3 and I have decided to move back to the US with them and finish the process that I started before I came to canada.. we've been communicating with the NVC so they dont close our case. But i am afraid of leaving because I dont know if he is going to be granted the extreme hardship waiver and how long he's going to have to stay here all alone in the cold and without any family or close friends...his 10 year bar for overstaying is due Oct 28, 2018. My worry is that they're going to deny the waiver because they can say I can just stay here with him and there is no extreme hardship, my daughters were not born in the US and I am a permanent resident here.. So i am a little confused on what to do.. its very hard for me to live in a country that I dont like.. what should I do? should I just wait until 2018 or should I just do the waiver and see what happens..the lawyer says its ok but im not convinced that the waiver will be approved...
