  • Green Cards

    We were issued EAD/AP cards for travel out of US to India. During our stay in India, we were informed that our AoS was approved and Green Cards were sent to our US address.

    Now we are are planning to return to US sometime in July/ August. My questions are :

    (i) Do we have to use AP card to enter OR can we enter with Green Cards that were sent to US address (asking my family to mail to our India address) instead of AP Card.

    (ii) Since the GCs were received during Alien's absence in US, is it legally permitted to mail them out of the Country ( US) to a different country (India) where the alien is on vacation?

    Immihelp Forum Members advice is most welcome, as I do not want to take risk.

    If the Green Cards can reach you, you can use them to reenter the U.S. But it is risky to send Green Cards by mail, and some courier services won't allow them to be sent (if declared).

    Use of Advance Parole option after a Green Card is issued may get the holder a scolding when reentering the U.S.

      Dear Mr Ray,

      Thank you so much for your immediate response with advice. I noted that when I use Advance Parole Card to re-enter, I may get a scolding from IO at port of entry, this I could not figure out the reason for scolding.. It is a fact that I did not get my AoS approval when I was in US, but I got AP Card as travel document to travel out of US. After our arrival in India after 15 days we were informed our AoS approval followed by Green card. As such , I feel there is no mistake from my side, and IO has no reason to scold, since GCs came when I was in India.

      Secondly, the purpose of our travel to India during the AoS process was mainly due to medical reasons followed by my father's ill health as he is 95 yrs now. I can produce all the certificates as evidence to IO officer for re-entry. Hope this would satisfy him for me to re-enter.

      I will be happy to receive your views/ comments on my explanation.

        Did you have an interview which resulted in approval of your status?

        In all probability, there probably won't be an issue when you reenter the U.S.

        But use of an Advance Parole after a Green Card has been issued may still result in you being scolded if the immigration officer at the Port of Entry can see on his screen that you now have approved Permanent Resident status.

          Dear Mr Ray,

          There was NO interview for us, since we are the parents sponsored by my daughter who is a USC. Our Green cards were approved within a record time of 4 months after submission, we submitted on 24th November 2015 and we received our Green cards on 23rd March, 2016. I do not know what to do, except I may have to face any scolding that may arise when we re-enter

            Then if there was no interview, your swift approval was the exception, but it's now a moot point.

            If you are unable to get the Green Card by courier or delivery by a trusted friend or relative, then just be prepared to explain that inability, but don't volunteer the information that you know the Green Card has been issued, unless asked.

              Thank you for your valuable advice. From your message, it is my understanding that we can get the Green Cards to India through a trusted courier or a friend or Relative. In which case we can straight way enter and the IO at POE may not raise any question as how did you get the GCs. From your information, it looks that mailing of Green Cards to the alien who is away on vacation in a different country ( other than US) to re-enter and is legally permitted by DHS/ USCIS.
