    I am an american citizen and came from S Africa with my wife and two children to visit my mother and father.

    We [my wife and two children]did not plan on immigrating before we came and will return in march 2007 to S africa anyway. We have been married one year.

    My father died in August and has left my mother alone in this house. I don't really want to leave her alone.

    Are changes of staus available in such a case.

    Your question is not very clear..................for whom are you seeking a chnage of status?...........your wife and children?......do you mean an extension so that they can stay longer than 6 months?..........if yes, you complete form I-539 for them and explain carefully why you are requesting it and send all the documentation you have proving your case....I belive you would get the extension.

    Your stay becomes legal once you file but if its denied, you must leave immediately once you get the denial letter. However your children are citizens and you could apply for a US passport for them while youre here

      I guess I wasn't very clear.

      My wife and her two children are S African. I, an American citizen. went over to S Africa and married her in Sept 2005.

      They came with me on tourist visas [10 year] for a visit. My father died and leaves a tough situation for me to leave my mother.

      We did apply for an extension a couple weeks ago for all three.

      I was just wondering if there are any special circumstances that allow me to apply for immigration for them.

      We are returning to S Africa anyway and may in the future apply to immigrate
      but if special circumstances allowed we might apply now; but I am only wondering ...... anyway, now. I just like to know things.

      You said my children could apply for passports. I should have said step-children. Could they ???? I am sorry that I was not clear.
