Help On Divorce Issue

Hi,

I married recently in india with no issues but after coming here we are facing certain irreconcilable differences. We have been searching for different options trying to set the things straight. But as one of the last resort we also thought of either annulment/divorce and I have a few questions on that option. I am on H1B Visa and she is on H4. Can we apply for annulment/divorce here in US. Recently I also appllied for I-485 including her too. Does this affect her stay here in US badly?

Reconcile

Please do try your best to reconcile with each other and live a happily married life forever.

Nobody is going to live to a thousand, the few years that we spend on earth can be done positively.

You're currently on H1-B so you're not an US resident only a temporary alien worker, hence you cannot file in the US courts for a divorce. You can however do so in India from here.

Of course, she's on a dependant visa attached to your H1-B, if she's no longer going to be your wife after the divorce, then she cannot stay in the country and definitely you cannot even file for her I-485.

Once again, do try your best to accommodate with each other. It's surely possible, just look at multiple options to put a band-aid on your marriage.
