    Hi,

    I am working with a reputed US based consultancy company on H1B visa. I applied for a leave to my employer to go to India. Unfortunetely the project , I was working on was cancelled by the client mentioning my performance wheras the actual reason was funds with the client. Now my employer is saying that I can go on a vacations and once I come back they will assign me a new project. They were also worried about the contract cancellation.

    Now as I am working on H1, is that a good idaea to go on leave for 2 weeks in a such situation. If I come back and they terminate my employment. In that case will I be able to enter US.

    I will appreciate the earliest response.

    actually you are safer going out of the country rather that being unpaid and out of status here.

    But if you lose the job then you cant enter but can find another employer to sponsor H1 (you will be cap exempt)

      In my company, they pay on bench. Only risk is that they might terminate my employment. But my manager has not intimated any such thing till date. He is saying that he is looking for a better project for me. I am not able to make anything negitive from their talk however i am worried.
