  • Specific I-130 questions.

    My fiance is a US Citizen and we have a couple of options. I accept a job I've been offered in the Canadian armed forces which is a three year contract and we make our relationship work, marry, I apply for my I-130, and see if the armed forces helps me break out of my contract, or I go with her to the US when she returns home, we marry, I apply for my I-130 while there. Here are my questions:

    1. What kind of financial stability do you need to have? She's finishing University, and I left my job back in March to spend the summer with her in her home state of California, then Oregon and she came back to Canada with me. Would the fact we're going to be living with her mother matter?

    2. Do they ask what you plan on doing for work, and if I told them enlisting in the US Army, would that make a difference?

    3. If I enlist in the Canadian Armed Forces, am I allowed to still apply for my I-130?

    4.Is it quicker to obtain a K-I fiance visa, and then apply for status change or just go for the i-130? Do you need the same amount of income to obtain a status change from a K-1 as you would for filing an I-130?

    Basically, I need to know by Wednesday if I want to join the army and deal with the possibility the army may not let me out of my contract once we do marry and my I-130 goes through, or if I go back with her, apply for my I-130 and pray we don't get denied based on our income. Some may say go the CAF route and wait, but by the time my contract is up, I'll be 27/28, which may be too old to start thinking about enlisting in the US Army, doing that until I get my citizenship and then hoping for Ranger training. I don't know of many 31 year olds entering ranger school.

    I swear if I knew where to get decent work illegally in Oregon, I'd do that until I had my I-130 haha.(Guess I better watch how I joke around :/.) You'd think they'd do all they could to get someone in wanting to enlist in their Army.
