I have one question. My brother is a citizen he brought his wife to the us on a fiancee visa she has a green card for 2 years which is going to expire in may 2008. We were told that 90 days before this date we need to file form I-751 to remove conditions on residence. Then in a year after this she could apply for citizenship. Fine however, she was arrested last week for shoplifting (first time ever) and is facing a disorderly persons offense (a crime in the state) with a maximum of 6 months in jail and $1000 fine in New Jersey. If she is lucks they will give her a municipal ordinance (not a crime in new jersey). Her criminal attorney stated she will probably get the municipal ordinance however maybe not. Anyway she is going to plead guilty to something either or will this affect her getting the conditions removed and then for citizenship? I did some research and it looks like probably not because it not punishable with a year or more of jail time. Is this correct? Thanks in advance.
